General conditions of sale and website terms of use

These Terms and Conditions govern the use of the websites praiadonortenazare.pt, nazarequalifica.pt and carsurf.nazare.pt, as well as the general conditions of sale applicable to purchases made through the online store at store.praiadonortenazare.pt. By using the websites or making a purchase, you declare that you have read, understood and accept these terms.

These terms apply to all purchases made through the Praia do Norte online store (store.praiadonortenazare.pt). The store sells official products related to the Praia do Norte brand, including clothing, accessories, surf articles and merchandise. Products are intended for end consumers, under the terms of Portuguese Decree-Law No. 24/2014 of February 14 (distance contracts).
The products available in the online store are presented with the highest possible accuracy, including description, photographs and specifications. Images are for illustration purposes only and may show slight color differences compared to the actual product, depending on screen settings. NQ reserves the right to discontinue products at any time without prior notice.
All prices displayed in the online store include VAT at the legal rate in force in Portugal. Shipping costs are presented separately during the checkout process and before order confirmation. The applicable price is the one displayed at the time of order submission. NQ reserves the right to change prices at any time, without such changes affecting already confirmed orders.
Payments are processed securely by Easypay, S.A., an entity certified by the Bank of Portugal. The following payment methods are available:

- Multibanco reference
- Credit/debit card (Visa, Mastercard)
- Apple Pay
Payment data is processed directly by Easypay and is not stored by Nazaré Qualifica. NQ does not have access to your credit/debit card data.
Deliveries are made to addresses in mainland Portugal and Islands. Delivery timeframes and costs are as follows:
- Mainland Portugal: estimated 3 to 7 business days
- Islands (Azores and Madeira): estimated 5 to 10 business days
- Shipping costs are calculated at checkout and depend on the weight and destination of the order
- In case of significant delivery delay, the consumer will be informed and may cancel the order at no cost
NQ is not responsible for delays attributable to the transport service. The risk of loss or damage to the goods transfers to the consumer upon delivery.
Under Art. 10 of Portuguese Decree-Law No. 24/2014 of February 14, the consumer has the right to freely withdraw from the contract, without stating any reason, within 14 days from the date of receipt of the product(s). To exercise this right, the consumer must communicate their decision unambiguously (for example, by email to geral@nazarequalifica.pt or by postal mail), and may use the withdrawal form available below.
To exercise the right of withdrawal, the consumer must:
- Communicate their decision to NQ within 14 days, by email (geral@nazarequalifica.pt) or letter, stating the order number
- Return the product(s) within 14 days after the withdrawal communication
- Products must be returned in their original condition, unused, with tags and packaging intact
- The return must be accompanied by proof of purchase

In the event of exercising the right of withdrawal, the direct costs of returning the goods are borne by the consumer, unless NQ has agreed to bear them or has failed to inform the consumer that such costs are their responsibility (Art. 13 of DL 24/2014). The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
In the event of contract withdrawal, NQ will refund the consumer all payments received, including initial delivery costs (except additional costs resulting from the consumer's choice of a delivery method other than the least expensive standard delivery offered), within a maximum of 14 days from the date NQ is informed of the withdrawal decision. The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise. NQ may withhold the refund until the returned goods are received or until proof of their dispatch is provided, whichever occurs first (Art. 12 of DL 24/2014).
Under Art. 17 of DL 24/2014, the right of withdrawal does not apply to the following contracts:
- Goods made to the consumer's specifications or clearly personalized
- Goods liable to deteriorate or expire rapidly
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, once opened
- Goods which, after delivery, become inseparably mixed with other items
- Digital content not supplied on a tangible medium, after execution has begun with the consumer's express consent
All products sold in the online store benefit from a 3-year conformity guarantee, under the terms of Portuguese Decree-Law No. 84/2021 of October 18. If the purchased product does not conform to the contract, the consumer is entitled to have conformity restored, free of charge. The presumption of lack of conformity applies during the first 2 years. To claim the guarantee, contact geral@nazarequalifica.pt stating the order number and a description of the defect.
All website content (texts, images, logos, videos, design, trademarks) is the property of Nazaré Qualifica, E.M. or third parties who have licensed its use. Reproduction, distribution or commercial use without prior written authorization from NQ is prohibited.
NQ is not responsible for damages resulting from: temporary website interruptions for technical or maintenance reasons; typographical errors or occasional content inaccuracies; improper use of the website by third parties; product unavailability due to stock shortage. NQ will make its best efforts to keep the website and online store accessible and up to date.
Under Portuguese Law No. 144/2015 of September 8, which transposes Directive 2013/11/EU, we inform you that, in the event of a consumer dispute, the consumer may resort to an Alternative Dispute Resolution (ADR) entity. Nazaré Qualifica also informs that the European Online Dispute Resolution platform (ODR platform) is available at:
The ODR platform allows consumers and traders to access alternative dispute resolution entities in any EU Member State through an electronic complaint. For more information about ADR entities, visit the Portuguese Consumer Portal at www.consumidor.gov.pt.
These Terms and Conditions are governed by Portuguese law. For the resolution of disputes arising from these terms, the courts of the Leiria district have jurisdiction, without prejudice to the use of alternative dispute resolution mechanisms provided for in applicable legislation.
